Brandon and his co-defendant Brody Laswell went to the victim's Randy Walker's house later in the evening of August 30th 2007 to drink . Brandon and the victim had been drinking buddies for many years. Brandon had been drinking nonstop for a week or more. And it was not odd to go to Randy's house to drink or do drugs. Brandon and Randy started drinking together when Brandon and Brody showed up at Randy's house. Brody had not been drinking. He was Brandon's ride for the week Brandon was drinking.

 

At some point something went wrong between Randy and Brody. And Brody went outside. He says while outside he smoked a cigarette and took off a dress shirt he was wearing. When Brody came back inside Randy lost his life. On September 1st 2007 Brody took Brandon to Brandon cousins house. Brody was bragging about what took place. Brandon do not have any details about what took place at Randy's. Brody was telling Brandon and Brandon's cousin what happened. The next morning September 2nd 2007 while still intoxicated Brandon called 911 to report that he thought he had participated and Randy's murder. Authorities immediately apprehended Brandon. It should be noted Brandon had been drinking nonstop for over a week at this point. And he was extremely intoxicated. They took Brandon to jail and put him in a cell for about 8 hours. The next morning they started interrogating Brandon. They only allowed 8 hours for him to sober up after over a week of drinking. The police took advantage of Brandon still being a little drunk and dazy.

 

At this point Brandon was starting the first stage of detox from over a week-long binge. The police got Brandon to agree to stuff he did not do. That now can be proven by evidence he did not do. At this point the police had already found Randy's body at Randy's house. They had found it days before Brandon called 911. The police had already removed his body. And Randy's Family had already started removing items from Randy's house. It was not considered a crime scene until after Brandon called 911. At which point the police made Randy's Family bring back all the items they had remove. The police then took Brandon's confession and went back to Randy's and started processing the now crime scene. Information obtained during the interview with Brandon and a warrant-less search of Brandon's cell phone lead authorities to Brody as an accomplice. Brody provided additional evidence implicating both Brandon and himself. Brandon trial started April 2009. And Brody's trial started two years after Brandon's trial even though they were arrested only a day apart. Brandon got ineffective public defenders while Brody had some of the best attorneys in the area. Brandon got the death penalty and Brody got a life sentence. The prosecutor stated during Brody's trial that Brody gave the death blow.

 

Brandon's confession should have never been used as a tool to set up the crime scene as he had very little real details to give them. In May 2005 Brandon was diagnosed with alcohol dependence alcohol amnestic disorder and depressive disorder. None of this was ever heard because Brandon's trial attorney did not call the doctor to the stand that diagnosed Brandon. Even though it was well-documented. So this allows the state to claim Brandon was not being truthful when he said he did not really remember what had happened at Randy's. but Brandon was diagnosed years ago with alcohol amnestic disorder. Brandon trial counsel was ineffective in every aspect his trial. And during Brandon's rule 37 which is ineffective assistance of counsel his trial attorneys took the stand and admitted they were ineffective and believed Brandon deserved a new trial. The attorney said he did not prepare for trial because he was more focused on another trial coming up after Brandon's. And he expected a plea deal for Brandon.

 

The Court the denied Brandon's appeal and said his trial attorney was effective. The Arkansas Supreme Court agreed. Now Brandon sits on death row and his co-defendant gets to live. the evidence in this case was clear Brandon and Brody we're both at Randy's house. The state's theory of who actually killed Randy and how came from the murk of the co-dependent. Nobody believes Brandon killed Randy. Brandon could not remember what actually happened. And while at Brandon's cousin's house before Brandon called 911 Brody was feeding Brandon false information about Brandon's role in the offense. Today we only ask that Brandon get a new Fair trial at which time a jury can see all the evidence. and he get effective attorneys. We Believe Brandon will be found not guilty of capital murder. Brandon should not be executed while the person the prosecutor said gave the deathblow lives. It is very clear Brandon and Brody did not go to Randy's house to kill him. The evidence shows this was something that took place in the spur of the moment. we ask that you support Brandon and getting a new Fair trial. That is the least the state of Arkansas can do.
